General terms and conditions of Kulturon GmbH, Musterstraße 1, 2460 Bruck an der Leitha ("Kulturon") for the purchase of admission tickets via the platform kulturon.at. This English version is provided for convenience; in case of doubt the German version applies.

1. Scope

1.1 These terms apply to all orders of admission tickets ("tickets") and other services via the online shop kulturon.at and via organizer shops (branded shops) operated by Kulturon.

1.2 A consumer is any natural person who enters into a legal transaction for purposes that cannot be attributed to their commercial or self-employed professional activity (§ 1 Austrian Consumer Protection Act, KSchG).

1.3 Deviating terms of the customer are not accepted unless Kulturon expressly agrees to them in writing.

2. Contractual partner

2.1 Kulturon operates a platform for the sale of tickets for events of third parties ("organizers") as well as its own events. Your contractual partner for the ticket purchase depends on the billing model of the respective event and is shown before you complete the order and on the invoice:

  • Sale in the name and on behalf of Kulturon: Kulturon is your contractual partner for the ticket purchase and issues the invoice.
  • Sale in the name and on behalf of the organizer: Kulturon merely brokers the ticket; the purchase contract is concluded between you and the organizer, who also issues the invoice. Kulturon acts as an intermediary and is not a party to the ticket purchase.

2.2 The contract for attending the event itself (event contract) is in any case concluded exclusively between you and the organizer. The organizer alone is responsible for the staging, content, schedule and quality of the event. The organizer is named on the event page and on the ticket.

3. Conclusion of contract

3.1 The presentation of events and tickets on kulturon.at is not a binding offer but an invitation to submit an offer.

3.2 By clicking the button "Order with obligation to pay" you submit a binding offer to purchase the tickets in your cart. Before submitting you can check and correct your entries at any time.

3.3 The contract is concluded upon receipt of the order confirmation by e-mail, at the latest upon delivery of the tickets. An automatic acknowledgement of receipt does not yet constitute acceptance.

3.4 During the ordering process selected tickets are reserved for a limited time (usually 15 minutes). After expiry the reservation lapses automatically.

3.5 The contract text is stored by Kulturon; you receive the order data and these terms with the order confirmation by e-mail. The contract language is German.

4. Prices, service fee and payment

4.1 All prices are in euros including statutory VAT. In addition to the ticket price a service fee per order or per ticket may apply depending on the event; it is shown before you complete the order. The service fee covers payment processing, ticket generation, delivery and customer service and is invoiced by Kulturon.

4.2 Payment is made via the payment methods offered during checkout (e.g. credit card, PayPal, instant bank transfer/EPS). The charge is made upon completion of the order. Tickets are delivered only after full receipt of payment.

4.3 Vouchers and discount codes can be redeemed according to their respective conditions; cash payment is excluded.

5. Delivery of tickets, ticket as bearer document

5.1 Tickets are delivered exclusively electronically as PDF (print@home / mobile ticket) to the e-mail address provided and are additionally available for download in the customer account. Please check your details and your spam folder.

5.2 The ticket is a bearer document: admission is granted to the person presenting the ticket with a valid QR code. Each QR code entitles to admission only once (it is invalidated when scanned). If several copies are presented, only the first person presenting is admitted. You are responsible for protecting your ticket against unauthorised access and duplication.

5.3 At admission the QR code is checked electronically (scan). The organizer may additionally request proof of identity if tickets are personalised (this is stated on the event page).

5.4 Commercial resale of tickets and resale above the printed price are prohibited. The organizer may block tickets in such cases.

6. No right of withdrawal (§ 18 (1) no. 10 FAGG)

6.1 According to § 18 (1) no. 10 of the Austrian Distance and Off-Premises Contracts Act (FAGG) there is no right of withdrawal for contracts for services related to leisure activities if the contract provides for a specific date or period of performance. This applies to event tickets. Withdrawal or exchange of tickets after conclusion of the contract is therefore excluded, subject to sections 7 and 8.

6.2 For vouchers without a fixed event reference, consumers have the statutory right of withdrawal of 14 days from conclusion of the contract, provided the voucher has not yet been redeemed.

7. Cancellation, postponement and changes of events

7.1 If an event is cancelled, the ticket price is refunded by the respective contractual partner (Kulturon or organizer, see section 2) via the original payment method. The service fee is also refunded if the organizer is responsible for the cancellation. Kulturon informs you by e-mail to the address provided with the order.

7.2 If an event is postponed, tickets remain valid for the new date. If you cannot attend the new date you may request a refund of the ticket price within 14 days of the announcement of the new date.

7.3 Minor programme or line-up changes (e.g. change of a support act, start time shifted by up to 60 minutes, relocation to an equivalent venue in the same town) do not entitle to a return.

7.4 Further claims (e.g. travel or hotel costs) against Kulturon are excluded unless Kulturon itself is the organizer; claims against the organizer remain unaffected.

8. Cancellation and refunds

8.1 Apart from the statutory cases and those listed in section 7 there is no entitlement to cancellation. Kulturon or the organizer may, as a gesture of goodwill, offer cancellation up to a date stated on the event page (e.g. up to 7 days before the event) against a cancellation fee; the service fee is not refunded in that case.

8.2 Refunds are made exclusively via the payment method originally used, within 14 days of acknowledgement of the refund claim.

8.3 If ticket insurance was taken out (see separate conditions), refunds in the event of personal inability to attend are governed by the insurer's conditions.

9. Customer obligations and house rules

9.1 The house rules and safety regulations of the venue as well as the organizer's visitor conditions (e.g. age restrictions, audio and video recordings, items carried) apply.

9.2 The organizer exercises the house rules. In case of violations, admission may be refused or the visitor may be expelled from the event without any entitlement to a refund.

9.3 Audio and video recordings in which visitors may be recognisable may be made at events by the organizer or Kulturon. Further information can be found in the privacy policy and on the event page.

10. Liability

10.1 Kulturon is liable for damages – other than personal injury – only in cases of intent or gross negligence. This does not apply to damages resulting from the breach of essential contractual obligations; here liability is limited to the foreseeable damage typical for the contract. Liability under the Product Liability Act remains unaffected.

10.2 The organizer alone is liable for the staging of the event, for damage at the venue and for loss of or damage to items brought along.

10.3 Kulturon does not guarantee uninterrupted availability of the platform. Maintenance work is carried out outside peak usage times where possible.

12. Dispute resolution

The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. Kulturon is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Complaints may be sent to office@kulturon.at.

13. Final provisions

13.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. For consumers this choice of law applies only insofar as it does not override mandatory provisions of the law of the state in which the consumer has their habitual residence.

13.2 For actions against consumers domiciled in Austria, the court in whose district the consumer has their domicile, habitual residence or place of employment has jurisdiction (§ 14 KSchG). For entrepreneurs the competent court at Kulturon's registered office is agreed.

13.3 Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
